Terms of Use

These Terms of Use ("Terms") are an agreement between you and Erim Icel ("we", "us", "our") governing your use of Turtle Escape: The Long Crawl (the "Game") and turtleescape.app (the "Site"). By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, please do not use the Game.

01Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Game. If you are under the age of majority where you live, you may only use the Game with the involvement of a parent or guardian who agrees to these Terms on your behalf.

02Your licence to play

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Game for your own personal, non-commercial entertainment, subject to these Terms and the rules of the applicable app store. We reserve all rights not expressly granted to you.

03Accounts and display names

• The Game creates an anonymous guest account for you automatically. There is no sign-up, no password and no sign-in of any kind, and the account is tied to the device it was created on.
• You are responsible for activity that takes place through your device and account.
• Your display name must not be offensive, misleading, or infringing, and must not impersonate another person or brand. We may change or reset a display name, and flag or suspend accounts, that break these rules.

04Virtual items and currency

The Game includes virtual currencies (such as Sand Dollars and Starfish Pearls) and virtual items (such as shell skins and cosmetics). These are licensed to you for use within the Game only. They:

• have no monetary value and cannot be exchanged for real money or transferred outside the Game;
• are not your property and remain part of the Game;
• may be adjusted, expired, or discontinued as we tune balance and content.

Except where the law requires otherwise, purchases of virtual items and currency are final and non-refundable.

05Purchases and refunds

In-app purchases are sold and processed by the Apple App Store or Google Play, not directly by us, and are subject to their terms. Prices and availability may change. Refund requests are handled by Apple or Google under their respective policies. You can restore previous purchases on a new device from Options → Restore purchases. Nothing in these Terms affects your statutory rights as a consumer, including any right to a refund under applicable law.

06Advertising

The Game may offer optional rewarded video ads: you can choose to watch an ad in exchange for an in-game reward. Ad availability is not guaranteed, and rewards are granted only for ads completed through the Game's own ad buttons. Advertising is provided through Google AdMob. How advertising data is handled, and your choices, are described in our Privacy Policy.

07Fair play and prohibited conduct

You agree not to:

• cheat, use unauthorised third-party software, bots, or modifications, or exploit bugs to gain an unfair advantage;
• tamper with, reverse engineer, decompile, or attempt to extract source code, except to the extent the law expressly permits;
• manipulate scores, leaderboards, currencies, or purchases;
• disrupt or overload our servers, or attempt to gain unauthorised access to them;
• use the Game in any unlawful way or to infringe the rights of others.

We validate match results and may flag, reset, suspend, or terminate accounts that breach these rules.

08Leaderboards and challenges

Leaderboards, the Weekly Challenge, and Game Center features are provided for friendly competition. We may remove entries, reset boards, or exclude accounts where we detect cheating, invalid results, or abuse. Your chosen display name is visible to other players on these boards.

09Intellectual property

The Game and everything in it - including its code, characters, artwork, sound, music, text, and branding - is owned by or licensed to Erim Icel and is protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works from the Game except as allowed by these Terms or the law.

10Availability and changes

The core Game plays offline; online features (leaderboards, cloud save, and the Weekly Challenge) are provided as-is and may be changed, interrupted, or discontinued at any time, including for maintenance or security. We may update, change, suspend, or discontinue any part of the Game or Site at any time, including modes, content, virtual items, and pricing. We may also update these Terms; when we do, we will change the "Last updated" date and, for significant changes, provide a more prominent notice. Continued use after changes take effect means you accept the updated Terms.

11Disclaimers

The Game is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so some of these may not apply to you.

12Limitation of liability

To the fullest extent permitted by law, Erim Icel will not be liable for indirect, incidental, special, or consequential losses, or for loss of data, progress, or virtual items, arising from your use of the Game. Nothing in these Terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence, or for fraud. Your statutory consumer rights are not affected.

13Termination

You may stop using the Game at any time and delete it from your device. We may suspend or terminate your access if you breach these Terms or where we reasonably need to. On termination, the licence granted to you ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) continue to apply.

14App store terms

Apple App Store

These Terms are between you and Erim Icel only, not Apple. Apple is not responsible for the Game or its content. To the extent required by Apple, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple has no obligation to provide maintenance or support for the Game, and any product warranty claim that cannot be disclaimed is Apple's responsibility only up to the price you paid.

Google Play

Your use of the Game obtained through Google Play is also subject to the Google Play Terms of Service. Where those terms conflict with these Terms in relation to your use via Google Play, the Google Play terms govern to the extent of the conflict.

15Governing law

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, except that if you are a consumer resident elsewhere, you may benefit from mandatory protections and the courts of your place of residence where the law provides.
